Mandatory SMIS. Taking into account the growing threat of man-made emergencies, we inform you.

The provisions of GOST R 22.1.12-2005 are mandatory for the relevant categories of objects, which is confirmed by the judicial act of the Supreme Court of the Russian Federation No. 309-ES19-17508 dated October 11, 2019, and the Resolution of the Arbitration Court of the Ural District No. F09-. 3593/19 dated July 16, 2019, containing the conclusion that the provisions of GOST were developed to ensure the implementation of the Federal Law of December 21, 1994 N 68-FZ "On the protection of the population and territories from natural and man-made emergencies", Decree of the Government of the Russian Federation Federation of December 30, 2003 N 794 "On the unified state system for preventing and eliminating emergency situations" and Decree of the Government of the Russian Federation dated March 24, 1997 N 334 "On the procedure for collecting and exchanging information in the Russian Federation in the field of protecting the population and territories from natural and man-made emergencies character"; SMIS is created to prevent emergency situations in order to prevent losses, damage to human health, material damage under the influence of destabilizing factors, as well as information support for decision-making by the day-to-day management bodies of the RSChS for the prevention and elimination of accidents (clause 4.2 of GOST R 22.1.12-2005); the provisions of the said GOST apply to organizations whose activities are associated with risks of harm to the life or health of citizens, the property of individuals or legal entities, state or municipal property, the environment, the life or health of animals and plants, and, along with other regulations, establish mandatory requirements for the creation at hazardous facilities a structured system for monitoring and managing buildings and structures.

The main goals of Law No. 68-FZ are to prevent the occurrence and development of emergency situations; reducing damage and losses from emergency situations; emergency response. In accordance with Article 46 of the Federal Law of December 27, 2002 No. 184-FZ "On Technical Regulation", from the date of entry into force of the relevant technical regulations, requirements for products or for products and the design processes associated with product requirements (including 4 surveys), production, construction, installation, commissioning, operation, storage, transportation, sale and disposal, established by regulatory legal acts of the Russian Federation and regulatory documents of federal executive authorities, are subject to mandatory execution only to the extent that corresponds to the purposes of: protecting the life or health of citizens, property of individuals or legal entities persons, state or municipal property; protection of the environment, life or health of animals and plants.

Objects that meet the criteria of paragraph 4.9 of GOST R 22.1.12-2005 are subject to mandatory installation of SMIS. The absence of GOST R 22.1.12-2005 in the List of national standards and sets of rules (parts of such standards and sets of rules), as a result of the application of which on a mandatory basis ensures compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures", does not indicate its optional. Upon completion of construction and receipt of the Statement of Compliance (COC) of the facility, authorized bodies verify compliance with mandatory requirements in accordance with P-01-01-21 Order of the Federal Service for Environmental, Technological and Nuclear Supervision dated July 2, 2021 No. 250 Part. IV, clause 1.2.3., clause 1.2.4 in part GOST R 22.1.12-2005, GOST R 22.1.13-2013.
