In accordance with article 46 of Federal Law No. 184-FZ in the Russian Federation since 28.03.2005, requirements for equipping capital construction, reconstruction, overhaul with structured systems monitoring and management of engineering systems of buildings and structures (SMIS) in in accordance with GOST R 22.1.12-2005 are mandatory, which is confirmed entered into legal force judicial acts of appeal, cassation instance, the Supreme Court of the Russian Federation in case No.A60-64004 / 2018.
Article 46 of Federal Law No. 184-FZ stipulates that from the date of entry into force of the relevant technical regulations, requirements for products or for products and processes related to product requirements for design (including survey), production, construction, installation, adjustment, operation, storage, transportation, sale and disposal, established by the regulatory legal acts of the Russian Federation and the regulatory documents of federal executive bodies, are subject to mandatory execution only in the part corresponding to the objectives: to protect the life or health of citizens, property of individuals or legal entities, state or municipal property; protection of the environment, life or health of animals and plants.
The main objectives of Law No. 68-FZ are to prevent the occurrence and development of emergency situations; reduction of damage and losses from emergencies; elimination of emergency situations.
GOST R 22.1.12-2005 "Safety in emergency situations. Clause 4.2 of GOST R 22.1.12-2005 stipulates that SMIS is created to prevent emergencies in order to prevent losses, damage to human health, material damage under conditions of destabilizing factors, as well as information support for decision-making by the RSChS day-to-day management bodies on prevention and elimination accidents.
Thus, the Provisions of GOST R 22.1.12-2005 refer to organizations whose activities are associated with risks of harm to the life or health of citizens, property of individuals or legal entities, state or municipal property, the environment, life or health of animals and plants, and along with other regulations establish mandatory requirements for the creation of a structured monitoring and management system for buildings and structures (SMIS) at hazardous facilities In this regard, the objects listed in clause 4.9 of GOST R 22.1.12-2005 must be equipped with an SMIS.
By virtue of clause 4.7 of GOST R 22.1.12-2005, the following subsystems should be included in the SMIS of an object: data collection and message transmission system (SSP); Crisis Communication and Management System (CCMS); monitoring system for engineering (supporting) structures, hazardous natural processes and phenomena (SMIK).
The absence of GOST R 22.1.12-2005 in the List of National Standards and Codes of Rules, approved by the Decree of the Government of the Russian Federation dated 26.12.2014 No. 1521, 04.07.2020 No. 985 does not indicate its non-obligation.
Taking into account the above, the current legislation already contains mandatory requirements for the use of automatic monitoring systems for engineering systems (SMIS) to prevent and prevent emergencies at facilities with a higher level of responsibility.
