Round Table Discussion on Improving Legislation in the Field of Industrial Safety of Hazardous Production Facilities

Speaking at the meeting of "Round table discussion" on the issues of improving the legislation of the Russian Federation in the field of industrial safety, First Deputy Chairman of the Duma Committee on Industry, Mr Vladimir Gutenev, noticed that over the last three years in Russia there were dozens of major man-made accidents and disasters, the greatest was the tragedy at Sayano-Shushenskaya Hydro-electric Power Plant (HPP).

Since the mid-1990s, state regulation in the field of industrial safety in Russia has been based on the principles and requirements of industrial safety, formed during previous periods, and it does not sufficiently reflect changes in the economic model, modern principles of legislative regulation.

In addition, much of the current edition of the rules of the Federal Law "On industrial safety of hazardous production facilities" is too general. It thereby transfers extensive powers in the field of legislation and interpretation of the law to supervisory authorities.

There are no adequate economic responsibility for violation of industrial safety requirements and consequences of such violations, which significantly reduces any incentives for modernization and technical re-equipment of hazardous production facilities. But existing information about hazardous production facilities can not adequately determine the status of their technical and technological security; since modern technical means of monitoring hazardous production facilities are not applied.

Following the results of the "Round table discussion", experts recommended that the Government and the federal bodies of executive power submit draft amendments to the Federal Law "On industrial safety of hazardous production facilities" with proposals of Russian industrial enterprises to the State Duma as quickly as possible.
